Motorcycle DUI: A Deadly Crime

Posted on in DUI Defense

IL DUI lawyerWhen you hear the term “driving under the influence,” you probably picture the driver in a standard sedan or perhaps a sports car. But a significant number of DUIs happen on motorcycles, and the results are often deadly.

More Motorcycles on the Road, More DUI Deaths on Motorcycles

About 8.7 million motorcycles were on American roadways in 2016, twice as many as there were in 2002. There were 5,414 motorcyclists involved in fatal accidents in 2016, and 25% of those drivers had a blood-alcohol concentration over the legal limit, according to the National Highway Traffic Safety Administration.

Conversely, there were 135 million passenger cars registered in 2016. 20,730 drivers were involved in a fatal crash that year, of which 21% were legally drunk.

Net, a motorcycle driver is 3 times more likely to be involved in a fatal crash than a passenger car driver, and 4 times more likely to be in a DUI fatal crash.

Recent Motorcycle DUI Cases in the Chicago Area

It was 11 p.m. on a Thursday night in June 2018. Two motorcyclists were speeding 90 miles down a four-lane road in Lombard when one of them crashed and died from a fractured skull. The other motorcyclist, a 30-year old man, fled to the home of friends, who later drove him back to the scene. The police arrested that man after observing several signs of intoxication, including slurred speech and a smell of alcohol on his breath. He was charged with felony DUI (because he was driving on a revoked license ) along with reckless driving and failing to remain at the scene of an accident. He was held in jail with bail set at $150,000.

In April 2018, an Elgin man was involved in a motorcycle crash in DeKalb. The 49-year-old man ran a stop sign and was hit by a passenger car that was moving legally through the intersection. The driver of the car was uninjured, but the Elgin man was thrown from his motorcycle and had to be airlifted to a hospital in critical condition. The motorcycle driver was charged with drunk driving and failure to yield.
